PHILOSOPHY OF TRIAL ADVOCACY

Our firm handles all types of civil disputes including simple and complex personal injury cases, wrongful death, product liability, premises liability, workers’ compensation, employment-related disputes and discrimination cases. We employ a pragmatic philosophy of seeking prompt resolution of disputes. This is accomplished by aggressively and judiciously preparing each case as if it were to go to trial. While it is true that more than 90% of civil cases settle before trial, being prepared and willing to go the distance maximizes settlement results. While the goal is prompt resolution of disputes through alternative dispute resolution, it is sometimes not possible and we are prepared to litigate cases to trial when necessary.

Personal injury, workers’ compensation, employment and civil rights law require a certain level of tenacity and the ability to overcome many challenges and obstacles unique to these areas of law. We have a history of going beyond the routine handling of such matters on behalf of our clients. We have handled complex cases involving “cross-over” issues in which an injured worker (entitled to workers’ compensation benefits) was also entitled to make a claim against a third party (personal injury) for the same accident such as a motor vehicle accident or a defective machine the worker was operating. In other cases, the injured worker had concurrent claims for wage and labor violations in addition to workers’ compensation benefits. Other cases involved cross-over issues of employment discrimination and workers’ compensation.

Through aggressive trial advocacy and meticulous preparation, we are prepared to overcome those challenges and have a significant track record of successfully handling such complex areas of the law. We have an extensive history of successfully litigating the various cross-over issues in the various forums.
